Is the paternity suit valid if not properly served?
My stepson has lived with us since May of 2010. He is 21 years old. His mother lives in Massachusetts and he lived with her from 2000 to May of 2010. Paternity papers were left in his mother's mailbox (not mailed, not served by a process server or signed for by anyone) just left in her mailbox without a return address stating he is being sued by his ex for paternity of her kid born in December 2010. He broke up with this girl in January of 2010 and swears he can not possibly be the father. Since these papers were never legally served on him is this even a legit suit? Also if he were to take the paternity test can he take it in Omaha NE where he lives now? Does he need a Mass lawyer? There is something about 20 days to respond to this thing on the first page that I am worried about but since he wasn't even legally served do I need to worry about this time limit? He is willing to take a DNA test to prove he is not the father but I am thinking this whole thing may be a hoax to begin with. What are his rights and does he have to even respond to this?
Can my daughter's biological father seek custody of her?
Can my daughters biological father try to take custody of my daughter.My wife and I were married for 9 years. We separated for about 2 months, during that time, my wife became pregnant. We had been intimate one time during the separation, and we got back together when we found out that she was pregnant. I had always suspected that I might not be the biological father, but since my wife never gave me any indication that she was with anyone else I assumed that she was mine.I filed for divorce from my wife and It was settled late last month. 3 Days before the case settled, my now ex-wife told me that she was 95 percent sure that I was not my daughters father. I asked her who her father is, and she said it is someone that I had never met, that she had told him that he might be the father, but didn't seem to have any interest in being the father. I had a paternity test done, and confirmed that I am not the biological father of my daughter. As far as I am concerned, I am still her dad, and always will be. I have raised her as my daughter for the last 2 1/2 years. My concern is if either my ex-wife or the biological father can try to strip me of my parental rights.I do not know what kind of contact my ex-wife still has with the father, or if he is even interested in attempting to do so. And I obviously can't trust her enough to ask her. Her paternity was never contested during the divorce and my name is on her birth certificate. I'm not sure who else knows about this, she states that her parents either already know, although she told her lawyer that they don't. The divorce decree states that the our children (we also have an 8 year old son) are with me 4 nights a week and with their mother 3 nights.
Can my lover avoid child support obligations if he denies paternity?
I am married and had a child with my lover (who is a US citizen but lives abroad). my husband has doubts about the paternity of the child and might ask for a DNA test. my lover does not want to be involved in any way in rearing or sustaining the child and I agree with him. is there any legal document he and I can draft that will exonerate him with certainty from any obligation towards the child? can he be forced to undergo a paternity test, and with what consequences if he is found to be the father of my child?
Do I have to pay child support after agreeing to an abortion?
I was seeing a girl about 14 months ago and we split up. About a month after we broke up she called me and said she was pregnant, but didnt know if the child was mine or her new boyfriends. We agreed on an abortion and i payed her the money for one. All was good until last week i recieved a phone call saying she ended up having the child anyway and that her boyfriend had a paternity test and the baby wasnt his. Now she says the baby is mine and wants child support. My question is do i pay child support even after we agreed on an abortion and i payed her for one. I never knew she had the child till last week!!! I was told this is a case of ENTRAPMENT. Please help me THANK YOU
Should my brother file for divorce and address paternity issues now?
My brother just found out his 8 month old baby is not his. They have been on the rocks for some time. He just wants to be divorced and move on. His wife has said she will get him for child support. He does not want to pay child support for this a child, because he feels it is time his wife takes responsibility for her actions. They also have 2 other children which he was told also may not be his but to him no matter what they are and he's going to take care of them. He did a home paternity test which the results say he is not the father to the baby. Should he file divorce and fix paternity during the divorce ( which has not been put in motion yet or should he go to court and get paternity settled? He knows who the real father is.
