Here is a legal argument that I feel is flawed. What is your thought? Argument: 'A Limited Liability Company is a Corporation and the Law has for many years required that a Corporation must be represented by an Attorney.'Rebuttal: 'A Limited Liability Company is NOT a Corporation. Single Member LLC operate like a Sole Proprietor with an additional layer of protection against liabilities attributed to the LLC and therefore the Single Member CAN appear in Court to represent the LLC just as a Sole Proprietor CAN represent himself in Pro Se. If there is more than one member of the LLC then, yes, an Attorney is needed because the interests of more than a single person must be adequate represented and one of the members can represent the interest of another without a license to practice law. Please tell me your thoughts; this one is bugging me...Please answer for the Michigan, North Carolina, and Generally.
Can IndyMac Bank pursue a deficiency judgment after foreclosure on my home?
I'm underwater $125,000 on my primary residence, other than that I have very little debt. If I let house go to foreclosure should I be overly concerned about a deficiency judgement Indy mac Bank coming after assets in Nautilus Fitness Plus, LLC formed in Nevada and Baker Properties, LLC formed in Va. Both LLC's are two member LLC.
What are the steps to transfer a property title to an LLC?
I am considering purchasing a resort condominium in Galveston, Texas for daily/weekly rentals. I have been advised to set up an LLC. I am the only member. I have a pre-approval letter from BOA for the loan in my personal name. The attorney I have said I should get BOA to title it in the LLC name. BOA said they don't do that. I would have to close on the loan personally and if I wanted to, a few days later I could transfer the title to the LLC. I have a few questions. What kind of deed should I use for this transfer? Are there any tax consequences from this transfer? Will I have to buy title insurance twice??
