What can a landlord do if a tenant is in jail and can't pay rent?
I'm a resident in Arizona my brother is renting an apartment and has been placed in jail for 120 days, What can landlord legally do since he is unable to pay rent?
What are my rights after a tenant broke their lease?
A tenant signed a lease for a full year and moved out in six weeks. I got a letter from an attorney saying I owe double the deposit that hasn't been paid plus attorneys fees? What are my rights? I feel she owes me money. What about my broken lease ($7,000 still remaining)? Plus, I've incurred costs to re-rent, like the new paint for the apartment that she painted a gross color ($1,100), the price of hiring a broker to re-rent the apartment ($700), which still has not been rented, changing locks ($100), damage to one of the locks from tenant ($100), etc. Do I owe her her deposit after she breached our contract?
Does a tenant need to give 30 days' notice without a written lease?
If there is no written lease in place and everything was done verbally, does the tenant HAVE to give a 30 day notice? If the tenant agreed to in lieu of paying a deposit, he would put the floors in, is he entitled to any amount of the deposit to be returned, even though he has not paid any amount to the deposit, just his own labor?
What are my rights if I broke my lease at the landlord's request?
We informed our landlord in april that we would not be renewing our lease and would be leaving by the end of July. He came back a week later and asked if we had any leads on a new place to move to since he had some one really interested in moving in by June. At his behest we put an application in and found a rental, gave our 30 day notice so that he could let the new tenants take posession by the first week in June. They canceled on him and he wrote us back not acknowledging that he was the one to request we break the lease and stated that we were responsible to the lease until the end of July since there was no tenant to move in. We discovered that he also had never given us a copy of our new lease (our mistake for not noticing). So we need to know what can we do. We would not have broken the lease terms without his asking us. We have none of this in writing and really can't afford to lose the new house either. Please let us know what we can do if anything. Am I obligated to stay in my rented building after a sale?
I bought a business 5 years ago and agreed to rent the building for 7 years and then I would buy the building. However, the owners decided to sell early. A new owner came in and nothing ha changed. We have not signed a new lease or anything. Am I obligated to stay in this building and fulfill my original lease or can I leave?
