Can I terminate my lease without penalties due to safety concerns?
How can I break my lease without penalties if my wife is in fear of her safety at night in the apartment complex and my vehicles have been broken into 7 times?
Can my tenant cancel the second year of our lease agreement?
My tenant of one year has decided to cancel the 2nd year of our two year lease. I believe this is a breach of contract and I would appreciate more info on this subject. The tenant is a single divorced woman and our relationship has been excellent. I could not believe that she would take such action. She knew that I was undergoing a major back operation which would make any action on my part difficult. Her notice was received by me a few days ago which makes re-renting literally impossible and people are not inclined to make moves during the Christmas season. I would be willing to work with her to delay her departure till June of 2007. I do not know the reason for her action as yet since I am still bedridden but I do know that it is not a job transfer since she does not work.
Can my landlord charge me rent after I moved out early?
I gave my 30 day notice in writing and moved out before my 30 days were up. My landlord took possession of the property, put them in a garage, put a pad lock on the garage, and locked me out of my apartment. Can she charge me for the 10 days of rent out of my deposit? I no longer have any way of entry. My lease was a month to month starting from the first to the first.
Is a lease binding if a student leaves the apartment?
My daughter and I signed a lease for a college apartment on campus. The lease was a nine-month lease and four payments were to be made in the spring semester. They are contending that if a student leaves, the lease is still binding and the spring rental must be paid. 1. Does a lease have to be recorded to be binding? 2. If the apartment is leased to another person, can they collect rent from both people? 3. If I have to pay the rent, can they make me vacate even though the student is not attending the university if I have paid the rent?
How can I manage frequent realtor showings while renting my home?
My landlord is selling the house that I rent from month to month. Our verbal contract is that I provide 30-60 days notice prior to moving. The written lease agreement has long expired, and was not renewed, I just pay as I stay. Recently the landlord has placed the property for sale and I am being bombarded by realtors phone calls and appointments to show the house. They give me little (12 hours at most, waiting for me when I get home from work the worst) notice. This is driving me up the wall, as I have two large indoor dogs which the landlord has given me permission to keep here. I am trying to no be a burden on their selling of the house, and they have offered to put my dogs in a kennel. I have worked with them by getting up on short notice, before I go to work, and utilizing this option, however after a couple weeks of doing this, it is wearing me out. The one time I refused to show the house to the realtor, she reported to the landlord that I am interfering with her sale, and then they call me and tell me what to do. I have already gone out of my way, to help them a few times here, and am willing to help, but they are expecting more than I can handle. How can I get the realtors to respect my time, and not call me everyday-literally? The landlord told me that he told the realtor to give me 48 hours notice, but the realtor calls the next day and wants to show the house in 2 hours. I am getting way to stressed out here and would like to turn my phone off for a couple days, but I fear I may be evicted.
