Can the town limit stairway access to emergency use only without maintenance?
The town of Smithville New York has decreed a stairway on a hill side as emergency access only thus precluding neighbors at each end from using the stairs The stairs is at the end of a town road that they do not maintain. How can they designate a stair emergency only, if they do not maintain the approach or remove snow in the winter time Emergency is to protect life and property. It used to be used in case of fire by the fire dept. The neighbors have used it for 50 years to get from upper properties to a lower bay property. How can one designate a stairs as emrgency use only seasonly when it has to serve the same purpose in the winter time? I am looking for the law that claims that if they do not maintain the stairs in the winter time then it is unconstituional, or an invalid law. This situation was brought about by an individual that had property at the bottom of the stairs that is owned by the Town of Smithville, NY and considers it his stairs, not legally, and does not want anyone to use the stairs. He convinced the town to make it an emergency access to keep all neighbors from using the stairs. There is one house on the approach road owned by the town but the house owner has to plow the town road even though he pays taxes for that service. That owner can not sell his house because the owner below yells at anyone trying to use the stairs including potential buyers. This owner of the lone house is desperate to sell. The value of his house has plummeted. I want to force the town to maintain the stairs and approach road to support their legal designation that the stairs is for emergency use only. Then maybe they will see how expensive it is and reconsider.
Does my son have legal recourse against a sewage contractor next door?
My son bought a home in Sept. and the adjoining property has been sold to a sewage contractor who plans to dump raw sewage by underground pipe. Does he have any legal recourse?
What are my grandson's options for recouping down payment in a divorce?
<p>My grandson and his legal wife purchased a home together via contract in her name as he has some child support issues pending. $8,000 down payment money was provided by family of grandson with $2000 provided by wife's family. Both have been paying contract now for approx 4 years, but it looks like they are heading for divorce.</p> <p>With the contract in her name what are his options concerning recouping at least the down money if she sells the property? Financial documents can be obtained attesting to this money if necessary. Can we file an injunction to stop a sale without this reimbursement?
Can I prevent condo sale without carpet and padding installed above me?
condo owner above me never installed 'cork silencer' before the tile went down _ they're trying to sell and I want an estopple letter or whatever you reccoomend so NO ONE MOVES BACK IN THERE nor DOES THE CONDO GET SOLD unless carpet and padding have been installed. am looking for this form of letter _ do i just file it at the courthouse or give to condo association?
How can we file for a temporary restraining order against pesticide spraying?
Without knowing exactly which entity is responsible, but having been told that the USDA is conducting an insect eradication program (this spraying over a one year period of time without notification) for a fruit fly. How do we file the appropriate forms to gain a temporary restraining order against this activity which has hurt our health, our landscape, and our livelihood. I have both physical material and photography to back up my allegations. This work has been done in the wee hours after 1:00 am. I was told that this kind of activity runs on a chain of command basis. A cooperative contract so to speak. We are suffering. Both adults and young people have been diagnosed with conditions related to human exposure to Organophosphate pesticides plus GMO yeast, Plus various fungal elements used as mediators. I really do need to know how to proceed now.
