Foreclosure

I am in a foreclosure default. They filed their documents in Riverside. I want to file an action against them in Riverside. If I file the complaint what do I have to do, if anything, with Riverside Records where they filed their non-judicial papers? Do you have a form covering this? Also, when I ask for a stay of the moving party with the courts do you have any form covering this stay?

We are trying to purchase a home that is in foreclosure. The home has a second mortgage on it. The second mortgage company that was served the foreclosure notice (and is the recorded mortgage at the clerk's office) is not the mortgage company that holds the current second mortgage. Are they considered to have been served if the original second mortgage company was the company served during the initial foreclosure procedure?

I am asking this question for my daughter and her family. They were served a foreclosure today by the sheriffs dept. stating there house would be sold to the highest bidder Nov.16, 2009. They have two small children, 8 mo& 2 yrs. I was told by someone that with two children the notice could be delayed an additional 90 days. Is there any truth to that or is their any way to get a foreclosure delay? My son in law has been out of work for 18 mo.

How can I stop a non-judicial foreclosure in a case where the lender cannot produce a complete copy of the Note? A Trustee's sale date has been set and I have a loan modification in process. How can I stop the non-judicial foreclosure or at least delay the sale date until the loan modification is processed? The property is in Arizona.

I have gotten a letter from court about foreclosure but I am currently in the process of modifying my loan. I need to respond to this letter. Can you tell me or send me a sample of a response to this kind of letter?
