Where should my son file for divorce and custody in California?
My son lives in Louisiana and his estranged wife lives in California. They got married in Nevada. They also have a son that lives in California, but right now his other grandmother has temporary guardianship in a different county from that in which his mother lives.
My question is: If my son wants to file for divorce and custody of his son, where should he file? And if in California, which county? The one that his son is residing in now or where his mother lives?
Do disability payments affect alimony obligations?
I recieve medical diability payments from a previous job, and was wondering if I would have to pay alimony to the ex-spouse ? I thought that alimony wasn't subject to paying alimony.
Can my husband terminate parental responsibilities and avoid visitation?
My husband has been diagnosed as bi-polar (12/06). Before this he had an episode where he had an affair, filed for divorce from me (which he has dropped) and fathered an unwanted child from the married woman he had an affair with. It is my understanding that since she was married at the time of conception and not legally separated from her husband the state will assume that her now ex-husband is the father and hold him accountable for child support until they prove otherwise. If paternity is established and my husband is the father, he does have the right to terminate his parental responsibilities which would still involve paying child support but not require any visitation, correct? Since we already have three children to support and he is the sole provider for our family, can the court order him to pay the full amount to this other woman for child support? I know the court can but how likely is it that the court would take away from the other children to pay for another one?
How can I obtain a reasonable visitation and support order?
My question is how to get my visitation and support order within reason. I have not worked since October 2003.
Should I sign the separation agreement my husband prepared?
My husband told me weather I sign the separation agreement or not, that he wrote his self, all he has to do is show proof that he has his own apartment with receipts proving we have been separated for one year and after the one year he can file for a divorce. He told em it is the law in Virgina. Am I suppose to sign the agreement or does this have to be done legally? Does it matter if I sign it?
