Should I mention FDCPA violations in my settlement offer for a debt?
I have been served on an old credit card debt (last payment in February of 2008) and would like to offer a settlement to a 3rd party collector - offering up to $8,000 on $26,000 debt. This collector and several others that were assigned to it before repeatedly violated FDCPA. The suit, in fact, was served at my in-law's home, a place in another parish where we have never lived or listed as our address. We have repeatedly given them our correct mailing and physical address. A collector also called my father's home and told disclosed specific details regarding the debt - amount, creditor, etc. Should I mention these violations in my settlement letter or let it go?
Can I place a lien for unpaid cell phone bills?
How can I place a lien on someone either against their assets or just have the lien filed so the person cannot acquire a credit card or obtain a loan? I had a verbal agreement with this person that they would reimburse me for payment made on their cell phone account. The amount I am owed is approx. $350.00 and to date the person has not paid me anything. This situation has been going on since August 2010.
Can I place a mechanics' lien for a personal loan in Texas?
More than 5 years ago but less than 10, my nice borrowed $3,000 from us for her wedding. She promised to pay us back within 6 months but, when time came to pay back, her new husband told us that 'blood-related' people in his book did not need to pay this type of loan! We disagreed with him but he would not discuss it further. He is a police officer in Dallas and twice my size, and half my age, so I did not feel comfortable making it more clear to him since I would not have much to defend myself if he got more upset then he was already for my trying to convince him and his wife to pay what was due to us. This niece and nephew have 2 children now and they have bought a house in Dallas but, I just heard that the house is on the market For Sale. My idea is to simply place a Mechanics' Lien on the property and if enough Equity is available to pay the $3,000 plus any interest that I can legally claim, I would go forward with this plan right away. If you see a good possibility for this plan to work against their equity on their house, we would like an estimate of cost to have this legal procedure done for us ASAP. Your reply and suggestions will be appreciated, --- I am now retired with only S.S. benefits coming in so I would like to collect from this malicious police officer (nephew) of ours.

What happens to joint tenants' debts if one dies?
How does a 2004 signed and authorized Quit Claim Deed and situation of Joint Tenancy with full rights of survivor ship have on the debts of one of the joint tenants if they die? Are the surviving joint tenants responsible for that parties non mortgage debts?
