Do we need an affidavit for a false charge in North Carolina or Florida?
I now reside in Florida. Six years ago I was accused by my then wife of attacking her in public. I didn't, but her lawyer used it to make the custody such, that I would have to pick up my children at the Waynesville city jail, where I would be arrested on assault charges, and stand court, on only her say so. I had my friend, whom I live with here in Florida, there as the only adult witness. She knows I did not assault my then wife.
My friend wants to attest, for court purposes, that it was a false charge, and sign an affidavit. Do we need to do one for North Carolina where the charge is still on the books, or here where we have residence in Florida?
