Can I reopen my divorce settlement for unpaid equity?
I was divorced in late 2000. In our settlement for the home, I was to get 25% of the first $80,000 of equity and 50% for remainder. It was to be based on realtors appraisals. I lost my job and was behind on mortgage and we went into the buyout and the amount given
to me was far below the amount as per the agreement. In fact, after deducting alimony I was paying before the divorce (which I was behind on), and taxes (which I was behind on), I was left with $0. I can prove that according to the agreement and appraisals I am still owed about $20,000. Is it too late to reopen this? I ask because now my ex is coming after me for more
child support even though I overpaid it for four years based on what I was earning.
What can I do if a company won't return my leased art piece?
I am a native artist, I had an agreement with a company who wanted to use a art piece for a calender and the company paid me $300 dollars for the use of the art piece. The problem I have now is that they think they own the art piece, and in the begining I told them that I couldn't sell the art for $300 but they could use it for their project but I needed the art piece back because it was a lease. I went up there last week and told them I needed the art piece back and they want me to pay them the $300.00 back. We did sign an agreement when they
paid me the $300, but I wrote on the agreement that it was a lease only. They have had the art piece since August of last year. What can I do?
Can I get a refund for unauthorized withdrawals from my account?
In 2004 I went to Curves. I signed a paper to take money out of my account but in early 2005 I told them that I could not come back because my husband was not working and I did not have the money. She said after a year it was on a month to month payment. I have had a lot of stress with a sick husband and dad working full time and taking care of the house and him I wasnt checking my bank statments as carefully as I should. I discovered she had been drawing $31.00 out of my account for 3 years and didnt see it. I went to the bank and they told me that I needed to put a stop payment but I have not been in the place in three years. Is there any way of getting my money back or get them to make this right? She said she was just honoring the contract but how if it was month to month?
Can I file a lien for my contributions to a property in Texas?
I entered into a oral agreement with my 8 year live in relationship girlfriend when we resided in Texas to purchase her relatives home to remodel and sell for profit for both of us. Since then
she has backed out of the sell deal and is keeping the home for herself, originating from a loan that she acquired through fraudulent means (8 times reporting of her income) attempting to leave out my interests, funds, and labor on the residence. She is looking into refinancing. Is
there a lien law that would cover my filing by a reasonable date after me finding out about her actions leading me to help her with this project?
Am I obligated to return my friend's down payment for owner financing?
I sold a house, via owner financing 6 years ago with the stipulations this person, a good friend (and still is), would obtain permanent financing within 2 years. My friend could not obtain permanent financing, so he has been making payments to me for the past 6 years. For the most part this has been a good arrangement. Just to make sure we had some kind of an agreement past the 2 year period, and since this person is not qualified to obtain a permanent
mortgage, we signed a lease agreement, in effect so they would continue to remain in the house and make payments. If my friend wanted his $30,000 back, would I have to return the money since it was never anything more than a down payment in the first place? It was not a deposit and the original agreement stated the money would be forfeited if he could not obtain the funds within the 2 year period (although he has the right to sell the house at anytime to get
his equity back if he needed to). If he were to break friendship and demand his money, what obligation am I under to return the funds?
