How would I get a motion for continuance due to a medical emergency?
I was ill and could not attend superior court hearing dealing with my civil case. I have doctors letters and more. My unlimited civil case was dismissed without prejudice. I need to know how to get my case back on the court calendar back on calendar. What process/ forms/ pleading do I use? I am still ill and need more time, as my doctors have requested for me and I wish to delay next hearing to show I have secured an attorney. What is the form for the pleading/motion I need and how do I fill it out. What verbiage do I use?

<p>I let a friend stay with me for a short time. Then we got into a argument and I told him to leave. He began to threaten me. I told him to leave again. I had a recorder with me and recorded him the second time he threatond me. I told him to leave and indicated I had a gun at
hand. He left. Then he called the cops and told them a pack of lies. He told them I had been suicidal and threatening him. The police took me in hand cuffs for a mental evaluation. The hospital told me to cooperate or I would not be let out. They forced me to take medication I
did not ask for and performed tests I did not need. The entire evaluation was based on my ex-friends lies. They tried to force me to take an addictive medication. I signed no papers and authorized no shots, yet I was still forced to take them. Then after treatment the drug they gave me had serious withdrawal effects. That was last year. Recently, I requested an itemization on the $2000.00 they say I owe them. Not only do I feal I should not have to pay this but I feel like my rights have been violated. I read something about the 14th ammendment.</p>
<p> Do I have a basis for a malpractice suit or other legal actions to resolve this dept and get it off my background check? The entire ordeal caused more mental anguish and jeprodized my college education. Do doctors have the right to force a person to take treatment they did not ask for, retain them and threaten to hold them for an indefinate period of time if they did not take medication such as Ethanol, and Thyroid stimulating Hormones?
Setting Aside a Default Judgment in California
After I responded to the unlawful detainer suit, a hearing/ trial date was set by the court , in California county of Orange, Harbor Justice Center, Newport Beach facility on a prearranged medical matter that was dated before the above mentioned hearing/ trial date set and I was notified of by mail. I was left with unreturned calls reaching plaintiff's attorney, until the day before where it was a court holiday. I notified him that I could not be in court, because of medical reasons, but he said he would have someone there anyway. I notified the court of the problem the morning of trial and said I could not be there and explained why, also mentioned that a letter would follow up via fax that morning. The fax was received later that day.

I am told after waiting for the fax I was found in default and a judgment was entered against me. I understand they have made one attempt to take possession of the property and failed based on technicality. I need to file a motion to set aside the judgment before they get possession rights. I notified the court, the plaintiff's attorney of my basis for none appearance, confirmed the conversation by fax, and offered immediate proof from the cardiologist if deemed necessary. Good cause is there for consideration in setting aside the judgment, entered by default, or however you might say it. Can you tell me the correct procedure for setting aside a default judgment against me?
How do I answer a complaint Pro Se?
I am attempting to answer a verified complaint (pro se) by a company in FLA (Miami-Dade Civil court). Do I have to answer everything in the complaint, by section and point by point - the sections are: FIrst, the Verified Complaint, then Parties Jurisdiction Venue, Facts, then Count 1, CountII and lastly, Verification? Or, can I simply send a letter explaining why I feel the complaint is unwarranted, and counter claim against the Plaintiff?I also understand that the FLA court system requires the parties to mediate differences. I have not been successful in mediating with the Plaintiff's attorney, thus far. Shall I also answer the complaint stating that they are being unreasonable with their demands?
