A HOME OWNED BY HER EX-HUSBAND AND HERSELF IS BEING FORECLOSED UPON. NEITHER PARTY IS INTEREST IN RETAINING THE HOME, A BANK DOES HOLD A TITLE ON THIS HOME, THEY HAVE BOTH BEEN SERVED PAPERS NOTIFYING THEM OF THE MONEY OWED, BUT NEITHER CAN PAY ON THIS HOME TO STOP THE PROCEEDURE. WILL THE BANK SELL THIS PROPERTY AND WILL THE MORTGAGE BE CONSIDERED PAID?

My ex husband recently passed away. We have been divorced for 2 years, but we had a joint checking account that he did not close out because he did not want to have to change his direct deposit information. What happens to the checking account seeing how my name is still on it? Does that make me liable for any bills? I currently live in KY, but the account is in New York where we lived. He stayed in New York.
Can a bank charge a fee to cash a check drawn on it?
If a check is presented at the bank on which the check is drawn, can the bank refuse to cash it unless the holder pays a fee to the bank? I can understand a fee if the check is drawn on a different bank, but I thought a negotiable instrument was an unconditional order to pay a specific sum of money to the person specified or to the bearer when presented. (The bank had no problems with the checks themselves, and in fact cashed them without the fee when I made them payable to my spouse who has an account with the bank).
(BTW, my "state" is the US Commonwealth of the Northern Mariana Islands--CNMI).
