What remedies are available if used car defects were hidden by salesperson?
I purchased a used car from a dealership, who provided the Carfax report which advised of a minor accident, to which the dealer responded stating that the paint missing from/scratched off of the bumper was the result of the minor accident. Before purchasing the car the dealer repainted the bumper and replaced the cluster due to the rpm gages not working properly. He gave us the original cluster and said the one he put in there showed about 4k additional miles, but since we have the original cluster we would be able to prove the mileage was lower if we ever decided to sell the car. He didn't reset the mileage on the cluster he placed in to the vehicle, but sold us the car as is with no warranty, writing not a salvage title on our legal documents. After a few days of driving the vehicle, less than 2 weeks, the cars roof leaked pouring water on to the driver ans passenger seats (pouring like someone was pouring a cup pf water in to the car), the hood was only connected to the car by one hinge, the car turned off when coming to a hard stop and couldn't shift gears quick enough to accelerate properly, jolting the car when trying to accelerate in speed. Glass drops out of the rear drivers side door whenever being opened or closed, the steering column was left open, and best of all the minor accident was actually the car being totaled. There are numerous issues with this car and the dealer is unwilling to fix the car while providing a rental car. When I asked the dealer why he refused to help when he sold me such a car his response was 'well I knewabout the accidents and I'm sorry I didn't tell you but if you're not going to be nice about it instead of being mad then oh well I wont help you' and hung up the phone. Is there any law stating this dealer sold me an unsafe vehicle, placed a fraudulent amount of miles on the car, and sold me a car without disclosing the details of the accident when asked, all the while knowing the car was in such poor condition? Please help. One lawyer said I have a great case while another advised there's nothing the law can do to help me right this wrong.
What Type of Offense is Presenting a Fake Insurance Card When Stopped By Police in New Jersey?
I gave a false insurance card to a motor vehicle agency and was arrested on the spot in East Orange, NJ. facing 6 months in jail but just paid a fine of $585. Is that a felony? Because it says felony on my DAC report.
What is a Car Leasing Scam?
I leased a car (first time) and I am wondering if the dealer cheated me. I would to know if some charges on the lease agreement are the usual ones or not. Normal like worried about the deal that. I signed the lease on 01/20/11. Do I have time to cancel the lease if something is wrong. Thank you.
Do I have grounds to sue for work done to my car unauthorized by me?
I used my car as a trade -in when I bought a used car from a dealership. After everything was signed and completed, right before I was ready to drive off, I changed my mind and decided I didn't want my old car to be part of the deal. I told the salesman and he said they wouldn't do anything with the car until they heard back from me. This occurred on Wed. evening. The salesman said he wouldn't be there the next day, so we agreeded I would come back on Fri. When I called on Fri. to be sure the salesman would be there, I was told by a manager that they had started working on the car because the rain had washed away the note the salesman had put on the windshield saying not to do anything with it. He said they had just done a safety inspection and replaced the front brake pads and turned the rotors. He said he would have the salesman call me. After waiting half the day I called him (salesman) and he told me they had replaced all the brakes and I would have to pay the cost for that $870.00 plus the $3000. which was the trade-in price. At this point I decided I would let it go and I went ahead and signed the title over to them on the following Monday. However, after more reflection I decided I did still want to keep the car. I called the next day and asked the manager if I could still buy the car back and he said, 'yes, if I paid what they had in the car'. He said I should call back and talk to the salesman tommorrow (Wed), that he would be in at noon. I assumed, after all this, they would not do anything else to the car but called the next morning just to be sure, and left a message for the manager asking them to not do any more work on the car. When I spoke to the salesman shortly after noon that same day, he said they had done more work on the car which amounted to $5500. I asked him to break that down for me and he said he didn't have that information. I asked him to check on that and call me back when he had it. I didn't hear from him that day or the next day, Thurs 5/26. I know I have made this worse because of my indecision. This started out as a verbal agreement that I could buy my car back for the original $3,000. that was the trade-in value. I did not authorize any of the work that was done subsequently. I did make a mistake in signing the title over, but after that the manager told me that I could still get the car back for what they had in it. And the amounts they're giving me are what they would charge for this work, not what it cost them. Based on these facts, would I have grounds to sue them, would it be worth the time and effort? The car is worth more than $3,000. Kelly Blue Book price for a trade-in is $6150. Thanks
Can a repair shop get title to a car that was left on site and work is unpaid?
We need to get title to a car that was repaired and owner will not pick up or pay. What must be filed with the court. We already sent them a certified return receipt letter and they picked up the letter but they have not responded. They also signed a form receiving the money from the insurance company that they were to pay for the car with.
