What can I do legally to sell property that we were never paid for moving?
Our licensed and bonded moving company moved a man (John Doe) from Austin to San Antonio. The move price was based on inventory submitted by 'John Doe' and bid by the company, but upon arrival the guy had 2-3 times more inventory. He wanted the additional amount also loaded and delivered to San Antonio the next day. When the crew arrived to unload, 'John Doe' said that he spoke to the owner of the company and rescheduled for two days later. Eventually the crew was able to start unloading that day and asked for payment (credit card information) before the trailer was completely unloaded. Upon request for payment 'John Doe' hung up the phone and has not communicated directly with the company since. He texted several times saying his phone was not working right. We have called many times to no avail. He told the people at the storage place in San Antonio (where some of his stuff was unloaded) that he paid us. We have the remainder of his inventory and need to sell it to recoup our losses. What do we legally do to sell the inventory abandoned by this individual?
How can I proceed in small claims court if I am unable to locate defendant?
A customer has left a piano at our place of business for more than five years. She has refused to pay rental or moving costs and other repairs we did. She has moved and will not give me her current address, though I have her phone number. I have sent papers advising her of small claims court procedings, but she will only give me a PO box number. How can I precede with small claims court? What is my best course of action?
Who owns a motorcycle that someone bought over two years ago but never picked up from me?
Two years ago an individual purchased a BMW motorcycle from me. The value was approximately $10,000 and that was the purchase price. He paid with a Suntrust cashier's check and I gave him a notarized bill of sale. The date was March 16, 2007. The title was delivered to me one week later. The individual communicated that he would be back in two weeks to get the bike. He never came to get the bike. I have called three times over two years, but each time he suggest he will come soon. He has never initiated a call to me and it has been over a year since our last communication. I still have the title, the bikes still in my garage. Who legally owns the bike and what is your advice?
What can I do with the abandoned property left a my store by customers?
I own a computer repair store near an Indiana college campus. When a notebook computer problem involves a motherboard, the fix costs more than the computer is worth. And, many times the students don't pick up their worthless computer so they don't have to pay our diagnosis fee. We are stuck with dozens of junk computers that will never be picked up. What can we legally do with them?
What can I legally do with the things a tenant left in the apartment when he moved owing us rent?
My husband and I inherited a tenant who is a registered sex offender. He and his family moved out in January without giving notice and have abandoned their belongings. The sheriff's department have not managed to track him down yet, and I believe a warrant may have been issued because he failed to register his new address. We need to get their stuff out in order to refurbish the rental unit and rent it out again. We're planning to start work in May. What are we permitted to do under Ohio landlord tenant law without incurring undue costs? We really don't want to pay for storage, especially as the tenants already owe us 3 months' rent plus a month's notice penalty fees. We bought the property last October but currently live in the Seattle area, so we have never met them and have no relationship with them at all. They didn't even have a phone and would rarely answer the door when our property manager called on them. We are moving down in May and will be taking over the property management.
