Is it legal for a boss to hire their own family over you?

Full question:

My daughter has worked for a Dairy Queen in Great Falls Mt. for the past 10 years. She was made general manager back in March of this year. Is it lawful for a boss to hire their own family (daughter and son) and knock you back down to manager, just so the daughter or son, can have that job title? Mind you, they have never worked there before and I think it is illegal for them to do this to my daughter. I thought it was called nepotism or something like that, but I can't find this definition.

Answer:

Nepotism refers to the practice of favoring relatives in hiring or promotions. While it is often viewed negatively, it is typically only illegal in certain public employment situations. Private employers can set their own nepotism policies, but they are not legally required to do so. However, private companies must adhere to diversity policies during hiring and promotions to avoid violating anti-discrimination laws.
