I'm writing a paper and I was wondering if you could tell me how old you have to be to move out of your house. And if you do move out at 16 with your parents permission can you move in with your boyfriend or girlfriend without getting them in trouble because they're 19? In general, parents are responsible for their children until they reach the age of majority, 18 in most states. The age of majority in North Carolina is 18. Under certain circumstances, a minor may petition a court to seek an order of emancipation, which would "free" her from her parents care and contol. An encipated minor would them be able to sign contracts, make decisions regarding her affairs, and in effect set up her own living arrangement.
When considering whether or not to emancipate a minor, courts will take into account several factors such as: (1) Typically the minor must be at least 16 (California allows at age 14) (2) Whether or not the minor can support herself (3) The minors ability to make decisions and exercise mature judgement.
