What should I do to be able to visit my son or even talk to him?

Full question:

I have a son that is 5 years old and his father has legal custody of him (we were never married). I am in the navy and on sea duty and have not been able to visit him much in the last 3 years but always did what I could when I could. He complained that I never called but once every 2-3 months. He is now married and so am I. He is denying me visitation with him and wants me out of his life for good. What should I do to be able to visit my son or even talk to him?

Answer:

You will need to petition the court for custody/visitation. If you already have been ordered visitation, you will need to file a motion for contempt if it's being denied.

FAQs

In Massachusetts, when parents are not married, the mother automatically has sole legal custody of the child unless a court order states otherwise. The father can seek custody or visitation rights through the court system. It's important for both parents to establish their rights legally to ensure the child's best interests are met.
