Full question:
I am a 38 year old man living in NY, going through a divorce in the state of New Jersey. I was married from July, 2005 , and ceased cohabitation in September 2006. We had no children, rented an apartment, and the only thing purchased during the marriage was a new car for her. My question concerns the engagement ring that I gave her. Do I have any claim to it? I would just like to sell it and split the money. Although I did move out willingly, does it matter that she is the one who actually filed to dissolve the marriage? Additionally, in our property distribution, she failed to mention that the car was purchased less than a month after our marriage...I already owned my own car, so can I claim any possession of the car she bought?

Answer:
New Jersey is an equitable distribution state in which the court, if the parties have not entered into a settlement agreement, will divide the marital property equitably between the parties, taking into consideration many factors such as; the duration of the marriage, the standard of living established in the marriage, etc.
