How do I get custody of my granddaughter that I am already caring for?

Full question:

Our son lives with us and has custody of his daughter. He is doing drugs while we are taking care of our grandaughter. He says he is not doing anything and refuses to get any help. His x wife is the same way. Is there any way for us to get custody of our grandaughter? I don't want her to be around this kind of behavior and we don't want it in our home. We have tried everything to get them to stop.

FAQs

In a custody case, factors that may negatively impact a parent's position include evidence of substance abuse, neglect, domestic violence, or an unstable living environment. Courts prioritize the child's safety and well-being, so any behavior that suggests a parent cannot provide a safe and nurturing home can be detrimental. Additionally, lack of involvement in the child's life or failure to comply with court orders can also reflect poorly.
