Two years ago I went to sessions court to answer to a charge of theft of $49.00. I was put on probation of 6 months and not to return to the store after that period was up. My attorney had it expunged from my record. This past Friday 10/19/07 I was caught taking an item from a store valued at $ 310.00. The loss prevention documented it and it is on video so I didn't deny it. The police came, wrote up the police report, and asked if I had ever been arrested. I said no because I never have been arrested or in jail. I go tomorrow to be processed. Am I suppose to tell them about the expungment?

The expunged records are deemed not to exist and the person who is the subject of the records may deny their existence, however, they may be sued to impeach them or as character evidence in future proceedings.
