Do we need an estate attorney for my mother's house inheritance?
My mother passed away in October 2007. My sister wants to put the house in her name. She's living in the house and she's single. I'm married with 3 kids. My mother wanted us to split everything so I want the house in my name. Also, in case anything happens to my sister I'll be the executor. Do we need an Estate Attorney or a Probate Attorney, so we both can understand all of this. The house is paid off. I have kids and want them to be apart of the homestead also. Who do we need to talk to? We are not fussing and we do get along we just need to know what to do. My sister says if she decides to sell the house then we'll split everything down the middle, but she's not ready to sell yet.
Who inherits my uncle's homes without a will in New Mexico and California?
Last week my uncle died. He does not have a will. He has no other children except a step son who is over 18 but never adopted him. My uncle has a home in New Mexico and in California. Do the homes go to the step son or my uncles brother and sister?
Did my brother breach his fiduciary duty as executor of the estate?
My father passed away, with no will. My brother acted as Executor of the estate. He decided, without asking any party involved, to give half the estate to my fathers ex-wife. (2nd wife, no blood relation to his heirs) and split the remaining estate 5 ways. 3 blood decendants and two of his second wifes children. These people were not related to me and never adopted. My question is: Did my brother betray his Fiduciary trust? He refuses to provide my sister and I with reciepts or any accounting of funds. We are only talking about a total estate of under $50,000 and it has been three years, do I have any legal recourse?
What deed is needed to transfer property solely to my mother’s name?
Our family house was in both Mother and fathers names. When our father passed away in 1995, our mother was executor. She completed executors deed to put the house in her name and removed our fathers name.The deed did not get recorded. Our mother passed away in 2006.When selling the property after her death, we discovered it was still in both names. I(daughter) have been appointed successor executor to fathers estate and have letter of testemenary for both. What kind of deed do I need to remove father's name and put in mothers name only?
Can I use California small estate rules to retitle my dad's property?
My dad was an AZ resident and died recently in AZ. He had a vacant lot in Santa Maria worth 15-20K, no other property in CA . He had not retitled it in the name of his living trust. We will probably use AZ small estate rules (prop value _ 50K) to settle some insurance policies. Can I (the trustee/exector) use CA small estate rules to retitle the property to the trust? I live in AZ but need to settle some estate issues in CA.
