What forms do I need to add a successor trustee in California?
I am adding a Successor Trustee to a trust. I am not the original trustee but am now the sole trustee. I am wondering which forms to use from the US Legal Forms shown on the page below. What legal remedies do I have as a beneficiary in a trust?
What are my legal rights as a beneficiary in a trust? My brother is trustee. He will not give me any accounting reports, notice of administration etc. Can I seek any legal remedies?
What are the requirements for a Medallion Signature Guarantee?
This question has two parts and concerns Medallion Signature Guarantees. My mother died recently, naming me and my brother as beneficiaries on her annuities and successor trustees on her trusts. (1.) I was asked to fill out a form by the annuity company to continue to receive annuity payments. This form required a signature guarantee. The bank would not do this until I 'proved' that my mother in fact had an account with the annuity company. I told them that this was stupid: If my mother didn't have an account,the company wouldn't send any money, since the form was to be returned to them for processing. Yet the bank kept insisting that those are the rules for the Medallion Signature Guarantee. Who's right? (2.) I spoke to a mutual fund company where my mother held an account as trustee. They told me that to claim the assets, I needed to write them a letter explaining that I was a successor trustee, etc. and have it signature guaranteed. I asked whether they wanted me to submit a copy of the trust.They said no; when your bank guarantees your signature, they are also guaranteeing that everything in your letter is correct. This also seems dubious: Why would a bank want to take responsibility for something like this since the mutual fund account has nothing to do with them? Again, who's correct?
Can my husband claim half of a grant deeded home in a divorce?
If my father gives me a grant deed (only in my name) to his home while he is in the hospital (its now in his revocable trust and 100% paid for) can my husband take half if we get a divorce? I'm in California and I have 5 kids so my dad wants to make sure I am okay in his passing.
What can I do about my brother's actions regarding my father's trust?
My father developed a trust, naming me and my brother as co-power of attorney. My father died in 2003. My mother has had alzheimers since 2000. My brother has been very secretive about many things involving the trust as has the trustee, at US Bank. I have been summarly excluded from most of the decisions (medical, property etc.) concerning the trust. My brother removed many valuable items from my parents house, including my personal collection of baseball cards, and antiques my mother had collected, without my knowledge. The house was sold and demolished without me being notified. The trustee tells me it is easier to deal with one party, than both. My diploma's and other items were in the house. My main concern is for my 17 year old daughter. My father told me verbally, she would be covered in the trust, but I cannot find her name, she is my parents only blood grandchild. As I read the trust, my brother's family gets his 50%, even on his demise. Upon my demise, his family gets my share also, nothing for my daughter. This is just now catching my attention, as I have been distracted by other matters like my divorce and remarriage, etc.
