Do we have to pay rent during foreclosure proceedings?
My wife and I were recently informed by our rental company (landlord) that the owner of the home we rent has not paid the mortgage in about a year and now the house is going to foreclose. We have until 30 days after foreclosure (march 20) to move, but the rental company insists we still must pay full rent even though the home will be foreclosed on. My question is do we have to pay rent for the next two months. We are both full-time students and we have very little income. We also have 4 children and we are unemployed. We have never missed or been late on payment and we have lived here for nearly three years. What are our rights?
Can I file a civil suit after a foreclosure during a loan modification?
During 4/09 I had a Taylor/Bean mortgage that was in the loan mod process. 6/28/09 Taylor/Bean sends notice of loan mod 3 month trial payments, 1st being due 7/01/09. On 7/04/09 1st payment received by T/B. On 7/09/09 T/B forecloses on property recording it on 7/27/09. 8/02/09 2nd payment is received. 9/01/09 3rd payment received. 10/29/09 I receive a letter from OCWEN Loan serving, LLC with my Sept loan mod payment, 'insufficient to cure default'. I call the phone number provided, give them my loan number, and after three dept redirections, they tell me that Freddie Mac holds title now and they can't help me. Long story shortened; can I file a civil suit against them or put an involuntary lien against the property to stop an further sales of my home. Additionally what happened to my payments for July and August? Nobody seems to care or have any answers; however my family and I still live at the property, and I have no intent on leaving. Do I have any legal recourse?
What should I do about my irresponsible tenant's actions and criminal charges?
apt. in my home rented to very irresponsible woman. i am very concerned about fire. she leaves heat on high and clothes dryer on when gone. i check on these when i come home if she is not there. she has charged me with aggravated crim trespassing. TCA 39-14-406 other actions of her are causing a water leak and not notifing me. i discovered a damaged ceiling and walls and furniture in the room below. aiso constantly leaving outside door unlocked or not closed. aiso used a winters worth of heat in less than 45 days. radiant wall heater in bathroom also left on high and door opened up to within 2 inches of glowing coil. thinking about rep myself. 3/3/10 is court date. how concerned should i be?
How would gifting property affect my children's inheritance if I die before the mortgage is paid?
Hello. I anticipate taking out a mortgage on a property I own wholly, through my mother who named me sole owner in a Life Estate. My mother deceased in 2006. This property is and would continue to be my legal residence. I'm concerned about taking out a fixed-rate mortgage at my age of 67 to gift my only sibling, aged 69, half of the property's value. She is already named in my will to receive half its value upon my death. But I wish to gift her half of the property's value now. My four children are named in my will as the other half-inheritors. If I now remove my sister's name from my will, how would my children's inheritance be affected should I decease prior to the satisfaction of a 15-year mortgage?
Do we have legal recourse for undisclosed neighborhood fees?
We purchased a home in 7/09. On the disclosure statement the previous owners listed the neighborhood fees as $150 a year. However we've recently found that through quarterly payments we will be paying approximately $460 a year. Do we have legal recourse on this matter?
