How can we resolve a long-standing encroachment without moving the building?
An encroachment appears to have existed for a very long time. How do we resolve it without moving the small building that straddles two properties? am a realtor in CA involved in a transaction, as a realtor and as the buyer, where a small building on the property being purchased straddles the adjoining property.
Is a contract to sell a jointly owned building without consent legal?
My sister and I own a new York commercial building, We own tt 50/50. She is the president of the corporation. S he entered into a contract to sell the building without my signature. Is this contract legal or is it void.
Do the heirs of my deceased son have rights to the property?
I am a resident of Mississippi. I have a life estate in 66 acres of property, 60 of which I inherited, 6 acres my home. This was done when I remarried a little over 14 years ago, putting the deed in my three son's names with a life estate for myself and a will for my husband to be able to live in the home if I should die before him. One of my sons has died recently, so my questions is: Does the deceased son's heirs have his rights now? Can you tell me what I need to do, or is there anything to do in regards to the deed. I believe it is a quit claim deed. My husband is now almost 89 years of age, cannot care for himself, I am getting criticism from his daughters who live across the country, very nervous about all the situation of all this. My husband would not be able to live in our home by himself. I am concerned about how all this would affect my two sons, my heirs, in case of my death. I hope I have this stated plainly enough. My property is located in Warren and Claiborne Counties.
Can the bank help my daughter reclaim her foreclosed home?
Our daughter lost her job last year, could no longer pay her mortgage on a house she bought in 2008 that was soon under water, and got a job in Maryland. Bank of America has move to foreclosure (still pending) and rejected three short sale offers. She is trying to get information from the bank but will little success. Now she (a single mom) wants to move back into her house. She owes about 15K in past mortgage and has no job and no savings so cannot afford to pay any back mortgage or mortgage going forward (though we will help her for two or three months in the hopes she is able to get a job and afford the mortgage). Question: Is there ANY chance the bank will work with her to help her reclaim her house? We will appreciate an answer to help us make a decision today. We have a rental truck loaded with her furniture and stuff from Maryland and she wants to move in tomorrow! She is dreaming of reclaiming her lovely little bungalow and I say this is not reasonable. Help us settle this. Thanks!
Can I be removed from the HOA if the developer breaches the agreement?
I bought a home in a new development in Florida last year. I also was entered into a HOA. The development has stopped all construction, maybe due to the economy, and I am the only resident in the development other than the developer. I think he may be facing bankrupty or foreclosure and he has stopped all amenities that were supposed to be provided by the HOA. Can I be disolved from the HOA since he broke the HOA agreement? What are my options?
