Can I terminate my rental agreement and get my deposit back?
I SIGNED A RENTAL AGREEMENT, WITH A RENTAL PERIOD OF 4/1/10 - 3/31/10. I WILL NOT BE MOVING IN. THE AGREEMENT STATES: 'IT IS MUTUALLY AGREED THAT THE RENTER SHALL HAVE THE RIGHT TO TERMINATE THIS AGREEMENT AT ANY TIME BY PAYMENT OF ONE FULL DAYS RENTAL FOR EACH 24-HOUR PERIOD OR ANY PART THEREOF, DURING WHICH THE RENTER HAS RETAINED POSSESSION OF THE PROPERTY AND ANY ACCESSORIES/EQUIPMENT DURING THE TERM OF THIS AGREEMENT.' I PAID A $800 DEPOSIT, THE AGREEMENT STATES:'THE RENTER FURTHER AGREES TO MAKE A DEPOSIT OF $800 WITH THE OWNER. SAID DEPOSIT TO BE USED, IN THE EVENT OF LOSS OF OR DAMAGE TO THE RENTED PROPERTY AND AND ACCESSORIES/EQUIPMENT DURING THE TERM OF THIS AGREEMENT, TO DEFRAY FULLY OR PARTIALLY THE COST OF NECESSARY REPAIRS OR REPLACEMENT. IN THE ABSENCE OF ANY DAMAGE OR LOSS, SAID DEPOSIT SHALL BE CREDITED TOWARD PAYMENT OF THE RENTAL FEE AND ANY EXCESS SHALL BE RETURNED TO THE RENTER.' I NOTIFED THE OWNER YESTERDAY, THAT I WILL NOT MOVE IN. WHAT FORM/LETTER SHOULD I SEND VIA REGISTERED MAIL TO THE OWNER, AND CAN I GET THE $800 DEPOSIT BACK?
How can we evict a tenant for unpaid rent and damage claims?
We have given a house for rent in Sacramento CA.We have signed 1 year agreement will be completed around Jul 2010Two weeks back, there was leak in sealing and water came little lit into one room.Next day, we called roofer and fixed the roof and handy man came fixed sealing with dry wall and other stuff. Now tenant is saying, water leak damaged some his furniture and mold came on his bed. We have taken picture of bed with mold. Tenant is asking $4000:00 for damage and did not paid Feb 2010 month rent.Today, we have given 3 days to vacate notice personally but Tenant did not take it. From last 5 months, tenant did not allow us go into house for any inspection and they are not keeping in clean and safely. Please advise, how do we vacate tenant?.
Can my landlord enter for a pre-inspection with short notice?
I lease an apartment and provided, as required a 60-day notice to vacate my apartment. I provided this request to the office in writing on January 26, 2010. On that same day, by my door, I found a note from the complex (with my statement to vacate the apartment in 60 days) providing the normal rent for February and the pro-rate amount for March (move out date is set by them at March 26, 2010). Today, February 10, 2010, Outside my door, I received a letter stating that on February 12, they will be entering my apartment for a 'pre-inspection'. Are they legally and reasonably allowed to just provide this short of notice to do what they call a 'pre-inspection'. I thought I would have until my move out date of March 26, 2010 to deep clean my apartment. I am afraid this is just their way to hit me with 'damages'. An individual that just moved out was a smoker and was hit with a $400 fee to repaint his apartment (even though I believe every time an apartment is re-rented, it is required to be repainted.'

How much notice does my roommate have to give me before moving out if he is listed as an occupant on my lease? If moves out on the 3rd with no notice or mention of an intend to move is he responsible for his part of the rent that month?
