Do I need to disclose a sealed arrest when transferring my nursing license?
I had a violation at 16 years old in New York, which was recently sealed. I previously lied about my age and had forgotten about it. Until a background check was done and it came up. It is now sealed after 3 years of working on it. I am 44 years old now and a registered nurse wishing to transfer my license to another state. On the application it asks have I ever been arrested and why? Will I have to say yes and tell them why? What does it really mean to have your case sealed. I was young and made a mistake. What I did is very embarrassing to have to tell others. Every time I apply for a job, will I have to say that I was arrested. Will anyone know if they run my social security number or if I am finger printed? I work as a homecare nurse with an adult population.
Can I expunge a leaving the scene ticket in Pennsylvania?
I have a Pennsylvania CDL drivers license. About nine years ago I received a ticket for leaving the scene of an accident. I scraped a traffic light while making a turn. I did not know I did it, but a city worker witnessed it and called police. There was no damage to my trailer and minimal damage to the light post. Is there any way to have this ticket expunged from my license? This ticket makes it virtually impossible to get a truck driving job.
Can I get a dismissed 23152(a) expunged from my DAC report?
I got a 23152(a) on 6/15/2001 dismissed on 8/15/2001 and put on my USIS (DAC report). I need to get this expunged off my record. Is this possible? I understand it does not come off my driving record but it would come off my DAC report. How long would this take and what would the cost roughly be?
Can my son expunge a felony burglary charge after a guilty plea?
My son was charged with felony Burglary in the First Degree in Iowa but plead guilty to aggravated misdemeanor for punching fellow who slept with his wife. Any hope of expunging the felony charge?
Is my probation considered a sentence for sealing my record?
About 2 years ago, I was arraigned for a drug charge for possession class B. My lawyer was able to get me a Continuance Without a Finding and I was given 1 year probation. I saw the probation officer about every 2 weeks and at the end of the year, my probation was terminated, and my case was Dismissed. I asked the court to seal this record about 6 months later and it was turned down siting G.L. c. 276, 100A . The judge wrote that the general law permits "the sealing of criminal dispositions where probation was ordered before the case was dismissed and cannot be sealed for 10 years after the completion of a sentence". Is my year of probation a sentence? He further stated, "the above offense is a misdemeanor". As far as I know, I never pleaded guilty in this case and I was never convicted. This was quite devastating as I am in the medical profession. I believe that according to M.G. Laws that on job applications it is legal me to answer 'no' when asked if I have ever been convicted of a crime. Is this true?
