Can I stop wage garnishment for my ex-husband's medical debt?
I am being garnished for a debt that my ex-husband created prior to our marriage. The company that is garnishing my wages for his medical bills has informed me the bills were started in 1999; we did not get married until 2001. The garnishment was served in his name and my name as his wife. I have been divorced going on 4 years and he is remarried. Our divorce states that he is responsible for his bills and I am responsible for mine. This doesn't seem fair. Please HELP and tell me what forms I could use to stop garnishment from my check.
Can we loan our son $5000 without charging interest?
We are about to loan our son $5000 for a down payment on a property in Kingston, OH (Ross county) We want to use a promissory note for the loan. We don't want to charge him interest. We simply want him to pay us back in monthly payments of $100 until paid. I have read that this may present a problem with the IRS. Is there a way around this?
How can I protect my home from business liabilities?
My family business is failing. I only own 15% of the stock. My parents do not want to give me an equal or controlling amount of stock. I am the President of our corporation. I know the IRS and collection efforts will come to me first. How do I protect my home and my family from these collection efforts? They have not started as of this writing and I am thinking of putting my home in my wife's or child's name. Is this logical or am I grasping for straws?
What are my options for dealing with a travel trailer loan issue?
I am a 76 year old woman who, because of a 'scam', found that I have a travel trailer on my credit report. I was a party to this so it is not the banks fault, I just did something foolish. Now I found the person who was involved and has paid on the trailer for 5-1/2 years is not going to pay any longer. I went to work a year ago and was able to keep up on the payments, however, my job ended and I cannot pay the payments. The principal has all been paid back to the bank but I am upside down on current value. I have someone who will buy it on a short sale (about 50% of what is owed) but the bank won't consider the offer and wants to repossess it if/when I no longer make the payments. At this time I am 5 days past the due date. If the bank takes it they will have to transport then sell at auction and will only get a few thousand dollars for it. They will then sue me for the difference which will, with costs, be approximately what I owe on the trailer now. I have a 1996 pickup, a mobile home on leased land as my only real assets. I am on a deed with my son on his house but I have no equity in it. (We did this because both of us are single and want the other not to have to go through probate, etc. if something were to happen to him). What can or should I do? I have an excellent credit rating and FICO score and hate to ruin those in the last years of my life, it is an honor thing. I just cannot have the bank take the trailer or place a lien om my residence nor have them involve my son's home. Should I transfer the ownership/title of the mobile home to one of my children (have tried to sell it and can't) or put it into a family trust. What other alternative can you suggest?
Can my tenants use their security deposit for unpaid rent?
My tenants are moving out June 8 and are a few months behind on rent and are requesting to use their security deposit for a month and a half rent. They requested to remodel the bathroom because the husband was in that line of work in lieu of paying 100.00 extra a month for their dog. Both are on disability. Wife is having a risky pregnancy and husband has disk problems from a car accident. They are moving to Colorado with his parents. I may not get anything but will a promissory note help? Do you have any other suggestions?
