Can I terminate my contract with Brinks Security due to name changes?
I have a business to business service agreement with Brinks Security for a cash pick up/safe rental service. We have used the service for about 2.5 years. I want out of the contract. They want a hefty termination fee.The agreement was signed in our DBA name. We currently are no longer operating under that DBA name. The contract was also signed prior to our LLC even being established by law. I signed the agreement prior to becoming a legal member of the LLC. The 100% member at the time did not sign. Would the contract be null and void based on the above conditions?
Can I hold an employee responsible for cash drawer shortages?
I own a check cashing business, I would like a Employee contract, that holds the Employee responsible for her cash drawer being short and that if The Owner and Manager cannot find that money he or she has to pay it back to the company.
What are my options to recover a loan from my son's ex-wife?
My son and his wife recently got divorced. Prior to that I lent my son $44000.00 He repaid his half, according to court documents his ex-wife is liable for the other half. My son has to pay several thousands of dollars due to her from his stock options. I don't believe I will ever see this money from his ex unless I take action. What are my options?
Can renters sue me if they fall while painting my home?
I have a home that I rent out. I have regular insurance on the home but do not have it covered as a rental. The renters want to paint and I have no problem with that. However there are 20 foot ceilings and I am concerned about my liability if they fall off the ladder. Could they sue me? If I have them sign a release of liability for their personal injury, would that stand up in court?
Can I bill the seller for landscaping repairs for standing water?
My question is 'Can I get a landscape company come out and fix the problem with the standing water and have the seller billed for it?' Details that lead to the question. I bought a house last October 2009. During the property inspection by a reputable company they found that in the back yard the landscape is such that when it rains it has standing water. The seller agreed to have this fixed so that the water would run off properly. He did come out and put down a small amount of dirt, seed and covered with straw. It did not work. He has been out since that time and we discussed it again and I asked if he could put in a French drain which would have fixed the problem but he said that he would not go to that expense but would dig a ditch and let it run out that way. Over the last couple of months I have been contacting the seller and he keeps telling me I will try to get out there by the next week. To this day he has not come back to fix the problem. On 10/17/2010 I left a message on his cell phone that I was going to contact a landscape company to come out and provide me with an estimate on what it would take to fix my problem. As of today, 10/19/2010 I have not heard from him. I feel that he is trying to get out of his obligation since the warranty has expired but he has been aware of this problem before I moved into the house in October 1, 2009.
