How Do I Force a Landlord to Make Repairs in Virginia?
We entered into a lease agreement under the assumption that the landlord was an honorable man. Prior to signing the lease we asked for the following to be done: A window with broken seal be replaced, first floor wood floors be refinished, fireplaces and chimney cleaned and inspected. He agreed and the list is an addendum to the lease. He has failed to perform any of these tasks. In fact I found a towel had been shoved in to the flue of one of the fireplaces, so I know it was not inspected. During the walk through we identified a window with rot along the sill, all the floors are scratched, the wood railings and decks outside have signs of wood rot, a bathroom had tile falling off and mold visible (he grudgingly is repairing this), and a toilet that kept running. I repaired the toilet. We agreed to a $200 repair for tenants, but that should only be for repairs after the start of the lease. He is trying to impose it for repairs he failed to make prior to the start of the lease. We do not have the funds to move again and should not have to pay to move because the landlord is unwillingly to perform the maintenance he agreed to or as in the lease is his responsibility as it was pre-existing. How do we get the lease enforced and the repairs made short of moving out? Thank you.
