What are my options if a judge refuses to hear my bankruptcy motion?
A Judge in a chapter 7 Bankruptcy case, have refused to hear a Docketed MOTION, filed as pro-se, the case is open and the MOTION is docketed, Judge says in an E-mail reply to me, I quote 'Mr. Hussain, there was no hearing on your case on 8/1/11, and there are no hearing pending in the Bankruptcy court, I noticed you have an appeal in your case , you might want to check the District Court.' This appeal is for an entirely different matter, irrelevant to this new MOTION ,What is my legal recourse ? Am I right in thinking that the Judge is denying me the due process of law and therefore violating my CIVIL and CONSTITUTIONAL RIGHTS? If so, where do I complaint? Any other suggestion. How do I report this to the press? The chapter 7 Trustee also does not reply to my allegations? When a MOTION is filed , does it requires the Trustee to answer the allegations against him? Chapter 7 Trustee did not submit any reply/answer of my filed MOTION. I need this MOTION to be heard, I know the Trustee is at fault here, and I will need the Trustee to pay me back.Can I ask the chief Judge to appoint a new Judge?
What legal recourse do I have regarding my bankruptcy trustee's actions?
I obtained a student's loan for my son = $11,795 in 1996. filled for chapter 7 Bankruptcy in 1999. Chapter 7 trustee did nothing to stop collection, as a result the loan of 11795 becomes very large due to interest penalties and collection costs added = $29493 in 2009. Trustee before submitting his final closing accounts in 2009 pay = $20,513, leaving a balance of $9483/. this $9483 is now deducted from my Social Security Retirement benefits at the rate of $160/. per month. What is my legal recourse here? what is the law, did the trustee broke any laws? Why would the Trustee pay a partial amount ? What can I do to recover these amounts? Trustee already paid $20513 towards a loan of only $ 11795/ . How can I recover this amount?
Can a discharged Chapter 7 bankruptcy judgment affect my house title report?
I have a discharged ch. 7 3 1/2 years old, it contains a 'not satisfied ' judgement and a title co. wants to know the 'legality' because I do not want it on our title report of the house we are about to buy. Does this make sense ? I thought this debt was now uncollectible and should now be ignored ..
Will filing for bankruptcy satisfy my bond obligations with the Contractors Board?
A THE BOND COMPANY NOTIFIED THE CALIFORNIA STATE CONTRACTORS BOARD AND THEY NOTIFIED ME THAT MY LICENSE WOULD BE SUSPENDED IF THE MATTER IS NOT CLEARED UP BY JULY 7TH 2011.I'M FILING FOR CHAPTER 7 BANKRUPTCY AND NEED TO TO KNOW IF THIS WILL SATISFY THE BOND COMPANY AS PAYMENT IN FULL AND IF SO WILL THEY HAVE TO SEND A NOTICE TO THE CONTRACTORS BOARD TO RELEASE ME.I'M FILING FOR PERSONAL BANKRUPTCY AND THIS IS BUSINESS RELATED. HOWEVER ON THE AGREEMENT IT SAYS THAT I AGREE AS A FIRM AND INDIVIDUALLY TO FULLY INDEMNIFY THE SURETY CO. THIS IS A CORPORATION. MY WIFE AND I SIGNED THIS. HOWEVER SHE IS DECEASED.WILL BANKRUPTCY MAKE THE SURETY COMPANY HAVE TO SEND THE CONTRACTORS BOARD A NOTICE THAT JUDGMENT IS SATISFIED THEREBY SATISFYING THE CONTRACTORS BOARD? FORMER BOND COMPANY PAID A LOSS OF $1000.00 AND $2565.99 FOR THEIR ATTORNEY FEES. TOTALING $3565.99. IT WAS PAID OUT TO A MATERIAL SUPPLIER WHO WENT AFTER THE BOND.
Can I keep my Indiana properties if I file for Chapter 7 bankruptcy?
I am considering bankruptcy. I have lived in Florida for 1 year, and my house has a homestead. I have no equity in it. I would like to keep it. My mortgage payment is $1389. I also own 2 properties in Indiana that I want to keep. 1 property is a Apartment Building / paid in full/ in a LLC. The other is a home which used to be my primary residence which has been for sale for 2 years. The price right now is $239,000 and I owe $175,000. Payment is $1245.00 I am also renting it for $800.00 per month. My total income from Retirement Pension, Income property, and a part time job is $5700. I have $55,000 in Credit Card Debt, $243.00 Car Payment. I would like to file chapter 7. I did the Means online calculator and I qualified for 7. However I am worried about the Indiana properties.
