Full question:
There was a notice sent out by my new landlord that stated that after the 5th of the month a late fee and a court fee of $64.00 will be added to the rent. If I pay my rent on the 7th, can he charge court cost without going to court?

Answer:
A court fee is not prohibited by Mississippi state law. If your rental agreement does not specify that the court fee applies only if the matter goes to court, it could be a valid term of the contract. Generally, parties can negotiate contract terms as long as they are legal and not excessively unfair.
