How can we get out of our sellers contract if we decided not to sell our home?

Full question:

We signed a seller contract with a buyer---not in front of lawyer. Just involved my husand and myself. And other husband and wife buying our house. Due to some problems with us finding another place to live within the time frame of closing date at buyers request we are considering not selling. Do you have any right to back out from selling our home? They did not pay any money down on property for us to hold it. Also, from time contract was signed to closing is less than 30 days. This just does not give us time to complete our move. What are our options?

Answer:

We cannot provide advice but can provide information. Your questions would depend on the terms of the contract regarding termination or cancellation, as well as what the buyer will agree to. Regardless of the terms, if the buyer and you work it out by agreement to either cancel or extend that would generally be one way to resolve. Any change should be in writing for your protection.

FAQs

Yes, you can terminate a buyer representation agreement, but the terms depend on the specific contract. Review the agreement for any cancellation clauses. If both parties agree to end the contract, it's best to document this in writing. If there are disputes, consulting a lawyer may be necessary.
