Full question:
This question is about my 16 year old step daughter. In the divorce she was to split her time equally between her mom and dad. However, she has decided to live full time with her dad without changing legal documents. Her mother claims her on taxes and her ex-husband is directed to pay child support directly to the mother. The 16 year old is pregnant. She will continue to live with us(dad and step mother). Who is the guardian of the grandchild? The 16 year old isn't allowed to check herself out of school to go to her own doctor appointments; so, how will she care for a sick child if need be? Also, who claims the infant on taxes?

Answer:
Teenagers who have children generally have the same rights as adult parents. This means that the 16-year-old has the right to custody of her child. However, the legal guardianship may still depend on the specific circumstances and any existing legal agreements.
Regarding tax claims, typically, the parent who has physical custody of the child for the majority of the year can claim the child as a dependent on their taxes. Since the mother is currently claiming the 16-year-old on taxes, it may complicate matters for the infant's tax claim. It would be advisable to consult a tax professional for specific guidance.
As for medical appointments, if the 16-year-old is unable to check herself out of school, her parents or guardians may need to assist in managing her healthcare needs and those of her child.
