Answer:

Per 750 ILCS 30/3-2 a person who has attained 16 years of age yet is under 18 years and has demonstrated the ability and capacity to manage his own affairs, to live wholly or partially independent of his parents or guardian, may be considered a mature minor. A mature minor can file a petition for emancipation in the court under 750 ILCS 30/7. If the court is satisfied that the person is a matured minor, who has the ability and capacity to manage his own affairs and has lived wholly or partially independent of his parents or guardian, the person may be considered as an emancipated minor by the order of the court.

Per 750 ILCS 30/5, an emancipated minor is permitted to enter into valid contracts. It reads:

“(a) A mature minor ordered emancipated under this Act shall have the right to enter into valid legal contracts, and shall have such other rights and responsibilities as the court may order that are not inconsistent with the specific age requirements of the State or federal constitution or any State or federal law.

In the present case, you can file a petition for emancipation in the court. The court may verify your petition and allow it if you can demonstrate that you have the ability and capacity to manage your own affairs and to live wholly or partially independent of your parents. After emancipation, you can enter into valid contracts.

FAQs

Emancipation in Illinois allows minors, typically those 16 years or older, to gain legal independence from their parents or guardians. This process involves filing a petition in court to prove that the minor can manage their own affairs. If the court agrees, the minor is granted the status of an emancipated minor, allowing them to make their own decisions and enter into contracts legally.
