How can I transfer a Guardianship if I move from Kansas to Florida?

Full question:

we are moving to florida i have legal guardingship over her what do i need to do for me to have it in florida

Answer:

Your issue is one that is not settled law in some States. There are many different procedures depending on the laws of the States involved in transferring a guardianship or conservatorship.

If both States have adopted the UAGPPJA (Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act) the process is not difficult.  If not, your may have to file for a new guardianship in Florida and also file in Kansas to get permission to close the guardianship or get permission to move the ward. In these cases you would probably need a lawyer in both States.

It should not be this difficult but that's the law today.

Unfornately, Kansas and Florida are two States who have not adopted the UAGPPJA (Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act).  Therefore, you need to contact lawyers in both States to determine how best to proceed for those States.

To transfer guardianship to Florida, you typically need to file for a new guardianship in Florida while also obtaining permission from the original state to close or modify the existing guardianship. This process can vary based on state laws, so consulting with attorneys in both states is advisable to ensure compliance with legal requirements.
