Full question:
My sons father has asked me to appear at Dept of Revenue to decline services of child support so that his drivers license is not suspended. He says that this will not affect back child support of over $19,000.00 and that I can obtain support enforcement again after he gets a job. He has been out of work for over 2 1/2 years and on unemployment approximately 2 yrs. This doesn't make sense to me and I really need an experts advice. Please help!

Answer:
That is an incredibly large amount of back child support, indicating a serious lack of effort on the father’s part. It will be a matter of personal judgment whether loss of his license may be the motivation he needs to start paying off his obligations or whether he is manipulating you to keep doing as he has been doing. If he claims he needs his car to get employment to pay child support, you may want to consider how having a car has affected his efforts to get a job and pay child support up to now. For example, if he has not obtained any type of temporary or other employment nor provided any amount of support while unemployed for such a long period, then having a license will be unilikely to make any difference. The threat of losing his license, on the other hand, may be the incentive he needs to take action.
You may contact the revenue department at the link below to verify what the procedures are for waiving your rights to enforce your child’s support and what the restrictions would be for requesting assistance again in the future if you do so:

While it may be possible to decline certain agency assistance, a parent cannot waive a child’s right to support from a parent.
