Full question:
I was working and attending college and acting for Broadway until one day Jan 11, 2008 I was walking and hit by a school bus dragged and pinned under wheels. On today still under DR care that recently revealed that I may have to undergo surgery. I have major back and neck injuries, living basically homeless from room to room, on disability and walk with a cane. My case was screwed and no one can help me. No one could explain to me why no one can help me. I was told my 1st attorney never filed a claim against the school bus district..that had to be filed within 90 days and now I have no case..I have my entire case in my hand with paperwork with false information on it, false S.S.#..and other false information. March 8,2 008 I was riding on the passenger side in a car with a friend and a car hit the left front end of the car but I wasn't injury in that car. A guy appear to me 2 minutes later and refer me to his attorney..and since then my case went downhill.. Can someone please tell me can I obtain a 'LEGAL MALPRACTICE SUIT'..I even told my psychiatrist about all the problems & depression I underwent since going through this awful ordeal.

Answer:
To prove legal malpractice in New York, you must show that your attorney did not meet the professional standards expected in your area and that this failure caused you harm. Specifically, you need to establish three elements:
- The attorney was negligent.
- This negligence was the direct cause of your injury.
- If not for the attorney's negligence, you would have succeeded in your original case.
For legal malpractice cases in New York, there is a three-year statute of limitations (N.Y. C.P.L.R. § 214(6)).
