Full question:
My family purchased some farmland in 1967 and at that time there was a fence line that divided our land and that of the neighboring land. For the first couple years the fence remained. A few years later it was removed but a center post halfway across the field was left to set a boundry. Currently the neighboring land has been sold and they surveyed the land and told us that we have been farming the neighboring land for 40 years illegally even though everyone agrees there was a fence there and we have farmed it for that number of years with no complaints/discrepiencies. Is there a legal way or term used to show that we have had possession and worked this land for that period of years and purchased that land knowning the fenceline was the land line borders. They are claiming they own 30 feet onto the land we have farmed for those 40 years because of a roadway that didn't procede through and that they own half of the roadway even though it is not there. Is this considered adverse possession or what term can we use to defend our case that we have knowning owned this land for 40 years?
