How Do I Change the Real Estate Described in a Trust?

Full question:

I've since sold my house and said house was the address listed in my Revocable Living Trust. Now that I don't own that home and have since purchased a new home (5 years ago), I've completely forgotten to remove the old address and list the new one. What do I need to do at this point? Is there a form I need to fill out and have recorded?

Answer:

A revocable living trust may be changed according to the terms of the trust document. In order to make changes to a revocable living trust, a person may sign a Trust Amendment or sign a complete Trust Restatement. A trust amendment changes specific provisions of a revocable living trust but leaves all of the other provisions unchanged, while an amendment and restatement of Trust completely replaces and supercedes all of the provisions of the original revocable living trust. When new property is added to a trust, a property deed is filed, showing the transfer of the property to the trustee.

Yes, a revocable trust can have an address, particularly if it includes real estate. The address of the property may be listed in the trust document to identify the assets held within the trust. It's important to keep this information updated, especially if you sell or acquire new properties.
