Full question:
I broke a lease mid June. The landlord has turned down every applicant in the last month and a half. At the moment he does not have it advertised as he is out of town. A friend of mine placed an application 3 days ago - the landlord said that it looked good and would call him with an answer 2 days ago; he has not called. Can I sue this guy for not filling the apartment so that he can hold me to the lease?

Answer:
If you have a lease, check its terms for early termination options. If the lease doesn't allow for early termination, you may still be liable for the remaining rent unless you can show the landlord breached the lease. However, landlords are required to mitigate damages by making reasonable efforts to re-rent the apartment. This typically means they should advertise and show the property to potential tenants.
Whether the landlord has made reasonable efforts will depend on the specific circumstances, including why they turned down applicants and their current availability to show the apartment since they are out of town.
