Full question:
We pay $620 for rent per month but if we are late there is a $10.00 charge for every day, so if we are late for 30 days it's $300. I have heard that the landlord can only charge 10% of what your rent is that month. Could you all let me know if I have to pay this late fee for sept 2007.

Answer:
In Ohio, landlords and tenants can agree on terms regarding rent and late fees in their rental agreements. According to Ohio law (Ohio Rev. Code § 5321.06), landlords can set their own late fees as long as they are not inconsistent with the law.
For late rent payments, your landlord can charge a daily fee, such as the $10.00 you mentioned. If you are late for thirty days, this would total $300. However, the law does not specifically limit late fees to 10% of the rent amount. Therefore, if your rental agreement allows for this fee, you may be required to pay it.
It's important to review your rental agreement for specific terms regarding late fees. If you believe the fees are excessive or not in accordance with your agreement, you may want to consult a legal professional for guidance.
