Can an expired foreign judgment be revived in this state?
Can a foreign judgement be transferred back into this state after the original judgement has expired. The foreign judgment was registered in another state 2 years after the original judgement and they made a mistake and let the original judgement expire. Therefore they registered the foreign judgement back in this state to revive it. Can they do that?
Can Pennsylvania enforce unemployment overpayment claims against me in Ohio?
I live in Ohio. Pennsylvania paid me unemployment compensation (although I never worked in Pennsylvania a company I worked for was located there), now they want some of it back claiming overpayment because I made a little money in Real Estate. I skipped a week per their instructions when I came into the money. But they claim I ran a business. Can I just ignore Pennsylvania or do they have enforcement powers from another state? I have appealed the decision so far.
Can a UK company sue me in the UK and collect in the USA?
Approximately 8 months ago I hired a UK company to perform work for us in the UK . We were on site with this company and they did not perform the work properly or supply the necessary amount of labor or equipment. Prior to flying to the UK from the USA I agreed to the estimated amount of 15,700 pounds. I reviewed with their representative on site the work that they did not perform and expected an adjustment in the invoice. When it arrived it was for the full amount. I wrote them a letter along with payment of 10,000 pounds. Now they are threatening to sue me for the remaining 5,700 pounds. Question: Can they sue me in a UK court? They will win of course if I do not pay for representation or show up my self. Therefore, can they collect from me in the USA and what is the procedure that they would need to go through to collect on a UK judgement. Lastly, they have threatened that I would be responsible for costs and interest if they bring suit.
Does a Miami court have jurisdiction over me in Connecticut?
I have been served with a Civil Action Summons from a Miami, FLA Court, by a FLA attorney. According to my investigation, the plaintiff is not registered with the Sec. of State to do buisness in CT. I now have to respond to the complaint. Does the Miami Court have the authority to apply it's juristriction here in my home state of CT? In other words, if the court finds for the Plantiff, can the long arm statutes give them the authority to enforce all their options? This company is an LLC, with a principal place of business in North Miami Beach, FLA.
Do we need to enforce our judgment in West Virginia?
We won a judgment in Smith County Small claims Court for the return of our dog. The defendants have yet to return the dog to us. We did issue a writ yesterday from the Smith County Small Claims Court. The problem is the person who stole our dog lives in West Virgina. They came to Indiana and returned to West Virginia with our dog. Are we going to have to take the judgment into the court in West Virginia? Are we going to have to sue again in the small claims court in there? We have a damage/compliance hearing on March 27th, 2009 in Smith County. The person we won the judgment against is from West Virginia.
