Full question:
I was wondering what the truancy laws were in Nebraska. The father of my 11 year old child did not return her on her April 13th visitation and she has not been in school since. I was wondering what the laws were for truancy and isn't this child neglect? Can child protective services be called in on him? And, will he face any punishment by anyone or can he if someone presses charges?

Answer:
In Nebraska, students are required to attend school during all days and hours that school is in session (Neb. Rev. Stat. § 79-201). Absences without consent from a parent or school authority are considered truancy. If a student accumulates twenty absences, the school district must refer the case to the county attorney's office. Penalties for truancy can include one to five days of suspension, and repeat offenders may face expulsion or require readmission through the Board of Education. Cases of habitual truancy are reported to the County Attorney. Regarding child neglect, if a child is not in school and is not being cared for properly, it may be appropriate to contact Child Protective Services. They can investigate the situation. If charges are pressed, the father may face legal consequences depending on the circumstances. This content is for informational purposes only and is not legal advice.
