Cab a separation agreement made before reconcilitation be effective.

Full question:

Two years ago, my husband and I planned to separate, and, had a separation agreement which was recorded at the courthouse. In the agreement, my husband agreed to pay me $700.00 a month. I had chosen the separation agreement because he is retired military and we have both medicare and tricare for life. I have numerous health issues, so, I felt this was the best route to take. We ended up reconciling for about two years, but, it is not working as he is an alcoholic, and womanizer, and a sociopath. Live is very difficult for me, and, I have decided to put the agreement in force. Since we had lived together during this time, I did not collect the $700 a month. Before I actually move, which I hope to do next month, I would like to amend the agreement to make the $700 an automatic deposit to my account. Otherwise, I doubt if he will pay it.

Answer:

It is not clear whether there was a Separation Agreement only, or a Divorce which contained a Separation Agreement.  If only a separation agreement, then the terms of the separation agreement would control as to whether the agreement remains in force or not since there was a reconciliation. A reconciliation may have made the agreement ineffective. If it was in a divorce, then it should be enforceable. You need to consult a local attorney about this before you take action that may not be in your best interest.

FAQs

Yes, a separation agreement can be overturned under certain circumstances. If both parties agree to modify the terms, they can do so in writing. Additionally, if one party can prove that the agreement was signed under duress, fraud, or misrepresentation, it may be deemed invalid. Legal advice is recommended to navigate this process.
