Full question:
Hi! I booked a reservation to a hotel through Priceline in Thousand Oaks, CA. When we checked in last night around 1:00 am, Saturday, the room has strong cigarette odor. We called the receptionist so we could transfer to another room but he said there is no available room. We turned on the AC, however, the AC was just blowing out hot air like a heater. We checked the thermostat and waited to make sure that the AC is working. However, it stayed the same still blowing hot air after 30 min. We called the receptionist again and he recommended to just open the window. We told him we booked an air conditioned room. We attempted to book other room from several other hotels within 50 mile radius bc we could not take it anymore. It is summer and air conditioning is a must. However, all of the other hotels are booked. We decided to leave their hotel in an hour and asked to have our money refunded because we are not taking their room. The receptionist told us to come back tomorrow. We told them we can't so as an alternative we asked for another option. He gave us a number to call back in the morning. Called the manager the following morning and the manager told us that he will only reimburse 50% of what we paid refuting that we used their room and that they could have sold it out to another person. I was aggravated because we did not have a choice but drive back home cancelling our day trip in Santa Barbara, Ca and driving for another 2 1/2 hours with heavy eyes just to have a place to sleep. What do I need to do?

Answer:
If you didn't receive the services you expected at the hotel, there are several steps you can take. First, keep written or email documentation of your requests, as this can help if you pursue a legal claim for breach of contract. Generally, oral agreements can be harder to prove, as they rely on one person's word against another's. Although you can file a breach of contract claim, consider whether it's worth the time and expense involved. You should also contact Priceline's customer service or the hotel chain's main office. They may prefer to resolve your issue to avoid negative online reviews. If you used a credit card for payment, consider reaching out to your credit card company to dispute the charge. A breach of contract occurs when one party fails to fulfill their obligations, causing the other party to suffer damages. Remedies for breach of contract can include money damages, restitution, rescission, reformation, and specific performance. Money damages compensate for financial losses, while restitution aims to return the injured party to their position before the contract. Rescission cancels the contract, and reformation allows for changes to correct inequities. Specific performance compels a party to fulfill their contractual duties when monetary damages are insufficient. If you believe your situation qualifies for a legal claim, you may want to review contract law and breach of contract actions specific to your state. Each state has its own laws regarding contracts, and you should be aware of the time limits for filing a claim.
