Full question:
I was driving down the free way, smoking a cigarette, when it burned my finger, and instinctively dropped it. I received a 470.00 fine with a mandatory court date next month. I really don't see the punishment fitting the crime, especially because I didn't mean to drop the butt. Is there anything I can do to Possibly get the fine reduced or possibly duped. This is my first offense. I have never gotten a ticket before ever.

Answer:
In South Carolina, littering laws impose fines starting at $200 for dropping litter, including cigarette butts. The fine can go up to $1,087, and there may be additional penalties like community service or jail time for repeat offenses. Since this is your first offense, you may have options to reduce the fine.
When you go to court, you can speak with the prosecutor about possibly reducing the charge or fine. While they are not obligated to do so, they may consider it if it serves the public interest. It's important to note that the law defines litter to include cigarettes and filters (S.C. Code § 16-11-700).
Since you have no prior violations in the last five years, you may have a stronger case for leniency. Consider consulting with a legal professional for guidance tailored to your situation.
