Can I file a civil suit for unpaid cleaning services after cancellation?

Full question:

I own a cleaning service franchise called Merry Maids. On 10/6/06 customer agreed to biweekly service on his home. He did not pay for 3rd & 4th cleaning. We cancelled their service for non payment. Made several phone calls, emails and letter. No response. Sent file to collection agency. No collection made. The date payment was not made was 12/4/06. Can I file a civil suit/small claims court? Is it too late? Thank you.

Answer:

In Pennsylvania, you can enforce a contract for cleaning services, whether it's oral or written. For a breach of contract claim, you generally have four years from the date of the contract to file a lawsuit. Since the customer agreed to service on October 6, 2006, and the payment was due on December 4, 2006, you are still within the time limit to file a civil suit or small claims action.
