Is it unlawful for children under 10 to ride ATVs near residences?

Full question:

My neighbors have 4 wheel gas powered ATV's for adults and kids. One kid riding is 8 years old, plus they are riding close to my residence. Is it not correct that it is unlawful for a child less than 10 years old to ride an ATV? Plus is it right that they cannot ride within 150 feet of a residence (mine) without the permission of that resident (me)? They are being extremely inconsiderate and I need to know if I have my facts correct, or indeed if I am missing something else?

It’s advisable to contact your local city hall, as there may be specific ordinances that impose additional restrictions beyond state law. However, according to Massachusetts law (G.L.c. 90B, § 26):

  • Children under sixteen and a half years old cannot operate an ATV across a public highway.
  • Children under fourteen must be directly supervised by an adult when operating an ATV.
  • Operating an ATV on private property requires permission from the owner unless the operator is the owner, an immediate family member, or has valid authorization.

Regarding riding near residences, local laws may vary, so checking with city hall is recommended to confirm any specific distance requirements or permissions needed.
